REGULAR MEETING
JANUARY 6, 2010 6:00 PM

The Mayor and Board of Council Members of the Town of Lake Arthur met this day in regular meeting. Notice of the meeting was duly exercised as per requirements of open meeting law.

Mayor Giles called the meeting to order at 6:00 p.m.

Council Member Dorothy Charles offered the invocation. Mayor E. R. Giles led the pledge of Allegiance.

Town Clerk Cynthia Mallett called roll and the following were present: Mayor E. R. Giles, Council Members: David Hanks, Dorothy Charles, Ellsworth Duhon and Kirk Conner; also attending were Town Attorney Bennett LaPoint, Chief of Police Cheryl Vincent, and Town Clerk Cynthia Mallett. Absent was Council Member Cindy LaPoint.

Dr. Deese, acting Coroner for Jefferson Davis Parish, was present and came before the Mayor and Town Council reporting the total of cases handled by the Jefferson Davis Parish Coroner’s Office for 2009. He also stated that the prices for 2010 will remain the same as 2009. The Mayor asked that he submit that in writing and the Council will need to accept it at the next meeting.

It was motioned by Dorothy Charles, seconded by Ellsworth Duhon to amend the agenda to add-Motion to introduce Ordinance No. 532, An ordinance amending Ordinance No. 520, enacting a budget of revenues, expenditures, and transfers for the Town of Lake Arthur for fiscal year August 1, 2008 and ending July 31, 2009. The motion carried unanimously.

It was motioned by Ellsworth Duhon, seconded by David Hanks to adopt the amended agenda. The motioned carried unanimously.

It was motioned by Dorothy Charles, seconded by Ellsworth Duhon to approve minutes of regular meeting held December 2, 2009. The motion carried unanimously.

It was motioned by Ellsworth Duhon, seconded by Kirk Conner to introduce Ordinance No. 532, An ordinance amending Ordinance No. 520, enacting a budget of revenues, expenditures, and transfers for the Town of Lake Arthur for fiscal year August 1, 2008 and ending July 31, 2009. The motion carried unanimously.

It was motioned by Dorothy Charles, seconded by Ellsworth Duhon to approve paying the bills. The motion carried unanimously.

Mayor Giles explained that he and his wife have granted a servitude for the Town of Lake Arthur.

It was motioned by Ellsworth Duhon, seconded by Dorothy Charles to approve a resolution accepting a servitude of way and passage. The motion carried unanimously.

RESOLUTION

A RESOLUTION ACCEPTING A SERVITUDE OF WAY AND PASSAGE

WHEREAS, the Town of Lake Arthur is in need of a servitude of way and passage so as to provide services to area residents, located in the Thibodeaux Addition in the Town of Lake Arthur; and

WHEREAS, Giles Living Trust, E. R. Giles and Delta M. Giles, Trustees, grants a servitude of way and passage as described below:
The North twelve (12) feet of Lots Four (4) and Five (5) of Thibodeaux Addition (Subdivision) located in the Town of Lake Arthur, Jefferson Davis Parish, Louisiana.

This servitude of way and passage shall be maintained by the Town of Lake Arthur as a road. The servitude of passage shall be granted for a period of 20 years.

THEREFORE, BE IT RESOLVED, by the Town Council Members for the Town of Lake Arthur, in regular session thereof on this, the 6th day of January, 2010, that the Mayor be and is hereby authorized to execute that certain agreement, by and between the Town of Lake Arthur and Giles Living Trust.

The resolution having been submitted to a vote, the vote thereon was as follows:

NAYS: None
ABSENT: Cindy LaPoint
ABSTAIN: None

Mayor Giles talked about the New Lake Arthur Pier that has been completed and the construction of the sidewalk near the pier as started. The Mayor announced that there are plans for a parking lot, near the pier.

Mayor Giles reported that Port Aggregates will donate 16 yards of concrete for the new Heliport that is being built on the property of the Lake Arthur Community Center.

Council Member Ellsworth Duhon announced that on January 30, 2010 the annual Cancer Mardi Gras Ball will be held at the Lake Arthur Community Center. Also, on February 6th, 2010 the Annual Mardi Gras run and parade will be held.

It was motioned by David Hanks, seconded by Ellsworth Duhon to adjourn meeting. The motion was carried unanimously. The meeting was adjourned.

ORDINANCE NO. 532
An Ordinance Amending Ordinance No 520, Enacting a Budget of Revenues, Expenditures, and Transfers for the Town of Lake Arthur for Fiscal Year August 1, 2008 and Ending July 31, 2009

NOTICE IS HEREBY FURTHER GIVEN that the Mayor and Board of Council Members will meet on Monday, January 25, 2010 at six (6:00) o’clock p.m., at the Town Hall, Lake Arthur, Louisiana, at which time there will be a public hearing on the adoption of the aforesaid ordinance.

All interested citizens will have the opportunity to give written or oral comments. Handicapped persons needing assistance or aid should contact City Hall before the meeting.
